1. Acceptance of Terms
By accessing or using the Mortgage Affordability service (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. We may update these terms from time to time, and your continued use of the Service constitutes acceptance of any changes.
2. Service Description
Mortgage Affordability is an information service that checks your mortgage affordability against UK lenders based on the financial details you provide. The Service provides indicative results showing how much lenders may be willing to lend you.
The Service does not constitute mortgage advice. We are not authorised or regulated by the Financial Conduct Authority (FCA) for the provision of mortgage advice. The results we provide are for information purposes only and should not be relied upon as a guarantee of a mortgage offer.
3. Account Responsibilities
When you create an account, you are responsible for:
- Providing accurate and truthful information about your financial circumstances
- Maintaining the security of your account credentials
- All activity that occurs under your account, whether authorised by you or not
- Notifying us immediately if you become aware of any unauthorised use of your account
Inaccurate information may result in incorrect affordability results. We are not liable for results based on incorrect information you have provided.
4. Payment Terms
The Service is currently offered completely free of charge — affordability checks across all 58 residential lenders and all 22 buy-to-let lenders, with no payment required. No card details are collected to use the Service.
5. Intellectual Property
All content, features, and functionality of the Service — including but not limited to text, graphics, logos, software, and the underlying technology — are owned by Mortgage Affordability and are protected by copyright, trademark, and other intellectual property laws.
You may download and use your affordability reports for personal use in connection with your own mortgage enquiry or application, including sharing them with mortgage brokers or advisors. You may not reproduce, distribute, or create derivative works from any other part of the Service without our written permission.
6. Limitation of Liability
To the fullest extent permitted by law:
- The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied
- We do not guarantee that the affordability results will be accurate, complete, or up to date, as lender criteria may change without notice
- We are not responsible for any decisions you make based on the information provided by the Service
- We are not liable for any losses arising from reliance on our affordability results, including but not limited to losses incurred from a lender declining a mortgage application
- We owe no duty of care to, and accept no liability towards, any third party — including courts, solicitors, or other parties to legal proceedings — who relies on results produced by the Service
- Our total liability to you for any claim arising from the Service shall not exceed the amount you paid for the Service
7. Disclaimer
Affordability results are indicative only and are not guaranteed. A positive affordability result does not guarantee that a lender will offer you a mortgage. Mortgage applications are subject to additional checks including credit history, property valuation, and individual lender underwriting criteria that are beyond the scope of this Service.
The Service is not a mortgage capacity report. A mortgage capacity report is a formal assessment of borrowing capacity prepared by a suitably qualified mortgage professional for use in legal proceedings, such as divorce or financial remedy proceedings. Results from the Service are automated, indicative estimates and must not be presented to a court, tribunal, solicitor, or any other party as evidence of your — or anyone else’s — borrowing capacity. We accept no responsibility to any third party who relies on results from the Service for any purpose.

8. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these terms
- Provide false or misleading financial information
- Attempt to gain unauthorised access to any part of the Service
- Use automated systems, bots, or scripts to access the Service without our written permission
- Present results from the Service as, or as a substitute for, a mortgage capacity report, or submit them as evidence in any court, tribunal, or legal proceedings (including divorce or financial remedy proceedings)
- Resell, redistribute, or commercially exploit the Service or its results without our written permission
9. Termination
You may delete your account at any time. We reserve the right to suspend or terminate your access to the Service at our discretion if you breach these terms or if we reasonably believe your use of the Service is harmful to other users or to us.
Upon termination, your right to use the Service ceases immediately. Any data associated with your account will be deleted in accordance with our Privacy Policy.
10. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or relating to these terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
